Legal file in office

A history of what happened between me and Eric Shaw, on May 30, 2017, which led to Eric attaching me 3 times.
Or, what was in the legal file he did not wish for me to see.

  1. Jeff asks for the Chalfonte legal file of all written legal decisions from our attorneys. He is ignored.
  2. Jim states that there is such a  file.
  3. I send an email to the legal committee and the president and the manager stating would like to review the file and will be in the office to get it on the Tuesday following Jim’s email.
  4. Mel Miller responds and we go back and forth via email.
  5. I send an attachment from Becker Polykoff that says all board members are entitled to all documents.
  6. Tuesday I go to the office. Donna took the day off.
  7. I ask Irene for the file She says she does not know where it is kept. I tell her to get in touch with Donna and ask her where it is.
  8. After a one hour meeting with Irene, Nancy and me, I ask Irene if Donna has responded. Irene says no.
  9. I call Donna from the office and ask her where the legal file is.
  10. Donna tells me the file is in her desk in the upper right hand draw. I can review it.
  11. I retrieve the file. I start to review the file.
  12. I was told by Donna that Jon has a copy of the file. Jon is on the legal committee. Jon told me he has not seen the file and states he would like a copy.  
  13. I go to the copy room and start to make copies for Jon.
  14. Eric Shaw arrives. He physically attacks me in the copy room. The attack was in front of witnesses. I was startled. I did not fight back but screamed at him. Eric is very strong and hurt me. I called the police from the office. I was bleeding from the face and my arm was hurt. Two weeks later I am still bruised.
  15. The police come. Eric is arrested and taken away.
  16. I was so shaken and shook up I did not go back to review the file.

I do not know what was in the file that Eric did not want me to see. I can not imagine what was in the file that would cause him to get so angry that he would attack me 3 times. And the attack was in front of 3 witnesses, Nancy, Irene and Krupa. I was startled. I did not fight back. Eric is very strong and hurt me.

Dear Rob,
I am reaching out to you, as I must have a legal opinion on how to handle the situation regarding the issue below.  The homeowner that wants to rent his apartment 2 months earlier than the association rules allow was just in my office.  The Board is arguing about getting a legal opinion and the owner was angry with me because he feels that he should have an acceptation to this rule.  His reason is that he has been a good and helpful owner for 25 years and a no decision will cost him thousands of dollars.
I do not have anything in our legal files regarding this issue could you kindly review.  I will take responsibility for reaching out to you.

This is an easy one.  Although, to my understanding, we have a standing  Chalfonte directive to keep all legal opinions we request in a designated Legal Folder in Donna's office for future reference, many have been requested by prior boards and are not included. Eric and Doug have the proper response. It requires a 2/3 vote by owners to change our bylaws. Jon is right, the legal opinion, as simple and clear as it is, should be on file if it is determined to be uncertain (as it has been certainly asked in the past and will come up again).
A simple solution to please all parties would be for Rob to simply search our past history and forward a past opinion. No charge.
In the event he can't locate a past opinion,  we can elect to have one written and paid for only  if so determined necessary by our new Legal Committee

Eric,
Do we have a standing opinion directive that all legal opinions are put into a Folder in Donna's office for future reference?
Can you have Rob search our past history and forward a past opinion,
No charge?
Can you do this request in writing and copy the board? Can you inform the board when you receive the opinions we do not have if any?
Donna, I will be in the office Tuesday to review the Legal Folder. Thanks.

Hi David.  Your request is very broad could u be more specific about issues and time frame?
The file I reviewed was of a general nature and I asked Donna for legal comments going back to 2012. She complied with what was in the "general" file.
If we ask counsel to copy or entire files it may be in the multi volume category. And for sure it will cost the the association for time and office work. And some may be privileged between the owner (s) and former boards. This could open us up to a real can of worms.

Please be more specific, I can assure u that Donna has a legal file up to date. This file however was badly handled when marek was in charge and may have some gaps from that period. Call me if I can help u.
