From Jon: Well folks I was going through some old Board of Directors folders and found the attached "Chalfonte Board of Directors Ethics Policy and Code of Conduct". It is posted on building link as well and has evidently been updated in 2016. But it is clearly listed as one of our "Policies and Rules" to follow:
It is very interesting reading. I urge you to look at it. Here are the pertinent excerpts from the Code of Conduct:
Board Members will:
* "Deal Honestly and in good faith"
o I don't think anyone would agree that Jim, Doug, Eric, Richard or Mel acted in good faith on the night of May 22nd at the election. They admitted that they acted deceitfully and underhanded.
o They did it again when Eric helped elect his replacement before leaving the BOD.
* "Never Knowingly mislead or lie to any other member of the association"
o Do you think Doug mislead any of us at the May 22nd election of Jim Shulman when he handed Eric the piece of paper with the notes on it? You betcha.
o Did Mel and Richard know what was going on when they voted for Jim?
* "Attend Board Meetings"
o When the 5 of them skipped the June BOD meeting (Jim admitted to me that "they did it out of protest") that was violating the ethics Code.
* "Not demand or accept any privileges for themselves or family and friends from the association not available to every other association member."
o How about Jim's three parking spots in the garage. Does everyone get those?
* "Avoid all conflicts of interest as well as the appearances of possible conflicts of interest."
o I think Doug and Harry's new venture is a huge potential conflict, to say nothing of Jim's real estate work in the building.
* "In case a conflict of interest should arise, the member must immediately disclose it and recuse himself/herself from any further board activity relating to the matter."
o Jim has gone out of his way to recommend Seagate to other condo associations. He needs to recuse himself from any dealings with them.
Now the question is - what do we do with this information. I encourage you to let me know your thoughts.
